change from CP to 485???what will be 140 ND

Hi,
My I-140 is still in process(ND-Jun2003) and i have opted CP.
Now i wanna change to I-485.
Will my I-140 ND will also change to the date on which my I485 papers are received by VSC.I.e. new ND for I140 will be issued
Or my I-140 will be processed according to the previous ND date and I485 papers will be added to my file..

please please if have any idea do reply.

Filing I-485 has nothing to do with the ND of I-140, it would remain the same.

Unless you have a very good reason i would advice you not to change from CP to AOS since the change will take about 1 year (I-824 approval) and then another 2 years to get your AOS approval.

Is there a specific reason why you want to change to AOS? One of us can advice!

My understanding is that if my I140 is in process and not approved then i dont have to go thru the I-824.
correct me if i am wrong.
So all i need is to send the I485 papers which will be included in my file and myI140 ND will remain the same and priority date will be given to me. And cp option will be removed.It will be somewhat concurrent filing if not exactly.
Am I Right????

You are right. Changing from CP to AOS does not involve I-824 (only applicable for the other way around). One can just go ahead & file I-485 for that.

i am with a contractor though quite big.
sometimes we have to be on bench without project, that time we have to be on Leave without pay.
SO there might be a gap for 1 month or more in the job..i s CP ok with this type of job??? Or should I switch to I485.

When i filed I140 with Cp project conditions were good and there was no chance of getting on LWP.
So should i change to 485 as my I140 is still in process.
