Chances of H1-B extension denial

I got laid off from my company four months back. Now I have got an offer for fulltime position. The new company guys are sponsoring my H1-B. But since there is four month "hole" in my pay stubs, the lawyer who is in charge of this transfer says, though CIS may approve my petition, they may deny the extension.

Does anybody know what are the chances of petition getting approved but extension denied? Does it happen very often?

If my extension is denied now, can I apply again after working for a year (I will have most recent paystubs then)?

Lastly, should I ask my lawyer to forget about the extension & just get the petition approved since I still have more than a years time on my current petition?
