My LC was approved in the first week of October. I concurrently filed for my I-140 and I-485 three weeks ago. I haven't received the I-485 receipt from INS yet.
I got laid off last week. But, my company is giving me severance pay for the next 5 months and is putting me on paid leave of absence. I will be getting a pay check every 2 weeks(as earlier) from my company for the next 5 months.
My company lawyer did not apply for my EAD and AP before when filing I-140 and I-485 concurrently. This lawyer is willing to apply for my EAD and AP now(I will be paying for the required fees) and my company said that I can use this lawyer's services.
My company laid off around 15% of its workforce(out of a total of 3000) last week. But, I am sure that my company is not going to inform INS(thru lawyer) that it laid off any H-1B employees. The only way(I think !!) INS might come to know that my company laid off so many employees is when all the laid off employees who are permanent residents apply for unemployment benefit thru EDD and Dept. of Labor notices this and informs INS that my company had some layoff's recently. And then INS decides to just issue RFE's for all the applications of employees filed on behalf of my company.
Is this realistic or am I just imagining ??.
My question is what are my chances of getting an RFE for I-140, EAD (or) AP ?. Even if I get an RFE I might be able to get an employment verification letter from my company but it probably will state that I am on paid leave of absence. Will that be OK ?.
