I guess my question is quite vague but I'd appreciate if you could share your thoughts on it. The reason I'm asking this question is because my wife is planning to take up a job on EAD based on my GC application. She is currently on H1.
What are the chances for 140 denial?
The cases that I have heard have been education and ability to pay related.
I am going through labor substitution, which is considered risky anyways. I don't feel that there could be education issues with my case as the LC requires a Bachelor's Degree or equivalent and I have a Masters degree from a US University. I also have plenty of experience as required in the LC. My employer (a consulting company) is paying me the same wage as in the LC + substantial bonus. The company is small (about 50-60 employees), but I guess they been profitable so far.
