I-94 Extension

how did you get the i94 EXTENDED. What is the motion to be filed. Can u pls explain. my brother is in a sililar sitution. he travelled on his previous employers visa. came back and joined his new employer. his i94 below the H1 HAS THE SAME # which he surrendered while leaving. thinking that the 1-94 below THE h1 is valid he never renewed his new I94 which he received while entering again. This was for a shorter duration which coincided with his H1 VISA stamp. how toi proceed with a motion now.

No Title

Congrats CG.I am also interested to know about the I-94 extension. One of my friend\'s wife is in that situation.By oversight they have not extended her I-94 which expired in April 2001 even though her H4 is still valid till 2003.Let me know the steps.

Thanks

I don\'t think you have to renew your I-94 except for visitors, please correct me!

Except for visitors every one will get a new I-94 (F1/F2/H1/H4) attached to the approval notice.

Even if you change your status from F1 to H1 or H1 to H4, you will get a new I-94 along with the notice. so you are staying legally even after the date on the old one (The one you got when you entered). so there is no question of 245(i). But if you forget to extend your spouse status after it is expired, then you are in trouble and have to go for 245(i)

Please correct me if I\'m wrong?!

message for ss321

normally ins tracks your ststus based on i94. it is difficult to explain but i will try. if you change employers and have applied for H1 tranfer that will get approved with the I-94 # YOU HAVE IN THE PASSPORT. nOW IF YOU TRAVEL AND COME BACK on your old H1 visa then you will get I94 for a duration that corresponds to the earlier employer visa. this may be shorter than the new I94 that you recev along with the h1 tranfer which will have the same # with whic you entered before .
