Certificate to certify non-availability birth certificate

Hello all-
I am planning to apply concurrently for I140 and I485.
I do not have my birth certificate and I understand I need to get an affidavit from my parents and a non-availability certificate.
Can some please advise:
1. what exactly does the birth certificate affidavit need to say? If someone can attach the language text, I would appreciate it.
2. How is this affidavit executed.
3. what exactly does the non-availability need to say? If someone can attach the language text, I would appreciate it.
4. How is this certificate executed? Who issues it and does it have to be from the place of birth?

Would appreciate if you could share any dos/don'ts related to this step.

Were U born before 73

Were U born before 73...only then U can give the certificate of Non-availability of Birth Certificates.

This certificate has to be issued by an Indian Municpal or equivalent Authority...

So There no test that anybody can provide for it..

Regarding Affidavit..
Get a lawyer...he will charge a nominal fee to get this done and he will be the right person to put the text..

any guidance on getting the Certificate of Non-Availability would be appreciated- who issues it- is there a set form or do we draft it- what is the best way to get it.

Certificate of non-availability

This certificate has to be given by the Corportation/Municipality/Panchayat or whatever authority that keeps the record of birth. Hence apply to your local office in your birth place, they will issue the certificate (if available a birth certificate otherwise a certificate of non-availability). This certificate should have the local office seal/stamp for authenticity. Some Corporation offices in India have a standard letter which states that the birth record of the applying person is not available on the records. If the language of the certificate is not English, then make sure you obtain a translation also.

My sister had the same situation. What the lawyer said ws just to get a letter or some thing from the official authority which keeps record of birth and death, saying that they dont have ur birth records. Thats what her lawyer said and she got the GC. This is around 5 years ago.

I am not a lawyer, but better talk with ur lawyer to get a format for the same.

Hi,

You will get the "No Birth record" certificate from the Muncipal Corporation only. Normally it is a standard format with them & will be in local language. You have to get it translated into English. You have to attach both the original as well as translated version. For affidavit format, you can use the following (ensure that you get it from atleast two elder persons --can be Uncle & Aunty too)
