Has anybody got into a situation wherein Fed DOL has asked to withdraw one application for the same candidate

Case Histrory(Applied in SF, CA):

Eb3 Non RIR - priority date: 9/27/99--Status: Cleared by EDD.. and Pending with DOL(Category: Account Executive)

Ed2 RIR: Priority date: 4/30/01--Status: Cleared/Transferred by EDD on 9/11/01 to DOL..Pending with DOL(Category: Account Executive)

Now Fed DOL has asked to withdraw one of the 2 cases before proceeding further...Can anyone advise..which one I should withdraw..

keep EB2 RIR application

i don't know if I am missing something, but don't you prefer RIR category with EB2, anyway now priority date is current and will be current by mid 2003, according to Labor department.

I am not expert or not with same case history, but i would withdraw non-RIR/ EB3 eventhough PD is two year earlier (1999).

I don't know how much H1 years you have left for 6 year clock.
it might make little bit differnce.

I am of the same opinion too. But the attorneys handling my each case is sticking to keeping their case and abandoning other and that confuses me.

I am left with 2.5 yeras on my H1.

Pls let me know if you can value add further and Thanks again for replying.

I made the call to withdraw EB3 and i got my labor approval forthe eb2 case
