Case Under Further Review

Hi.

After waiting since my interview from May, 2003, I had asked my congressman to check status for me and this is what I had received from USCIS:

USCIS records indicate that your constituent's case is under further review by adjudicating officer along with assistance of other agencies pertaining to the bonifieds of the documented evidence they submitted in support of their application and/or petition. Cases are referred for addtional review for variety reasons, which ..... may not be dislcosed......

Have anyone seen similar letter? Any advise or comment.

Did you get green card through marriage? If labor did you use AC21? If none of the above then my guess is that mean FBI background check. The time line definitely indicates that you are stuck in the name check queue.

Now USCIS is trying mighty hard through Specter to wriggle out of the 120 day rule.

I received my green card through my parents (was minor). Letter also indicated my FINGER PRINT clearance is current. Isn't this mean background check is done?

Sorry, but not familiar with 120 day rule. Can you explain?

name check is different from the fingerprinting. the 120 day rule is that after your initial citizenship interview, the government has 120 to issue a decision by law, after that, you, as an applicant, has the right to take the case to court so the judge could adjudicate the case.

I think that your case is being investigated because maybe somebody has told the USCIS a lie or something about your immigration status. It happened before. The other choice is that your name check is pending, and this could take years, unless you have mdecial emergencey, iminent military deployment, or pending law suit ( which is your best bid) there is nothing you can do to speed things up.

The word " along " with assistance of other agencies, could signify that the further review by the officer is one thing, and the assistance of the other agencies, which could be the FBI's name check, is a whole separate thing. Also, name check has nothing to do with "pertaining to the bonifides of the documented evidence they submitted"
I am just thinking, nobody could be sure.

your case is stuck becuse of name check...i do not think there is anyother reason...file a petition in the court...take advantage of it before they take it away.
