Case Transferred to local office

TSC, 485 RD: 7/2/01, ND: 7/24/01, FP:2/03

Case transferred to Miami on 2/2/04. Went to Miami INS. They told me i have to talk to INS Westpalmbeach as i live in palm beach county.

INS WPB told me that, they will treat these cases seperately from other 485 cases that are filed in the local office.So the processing times that we see on BCIS website are not valid.

Immigration officer also told me that, these cases are called FCO cases and are treated seperately in a seperate que. If less number of such cases are there in the local office, we get interview date early. Other wise it may take some time. She is not sure in my case , how many such cases are there in WPB.

she also said, i have to file my EAD and AP from now on with this office until i get approved.

She told me that, for some statistical reasons they will send some cases to Local offices .

Can someone from Palmbeach county tell me how long is it taking for INS WPB to schedule interview?
 
That is not what I heard

I spoke to my attorney. He did mention that transferred cases are pulled into a separate queue from locally filed cases. But he said it would not take very long (more than a month or so) to get an interview scheduled. The trick is to get the files to the local office and have an officer assigned to it. Now, who is responsible for doing that???

About filing for renewal EAD and travel document - he said the same thing as you pointed out.

I myself want to visit the local office (ATL) and find out the deal.

Could please give the case detail like RD/ND and transfer date ?
Already there are 4 cases transferred to Atlanta .

What I head is they are processing the case according to RD.

Are you one of the transferees? Where did you read four cases pending with ATL? What are their stats? And how do you know ATL is processing based on RD? Pls share the info.
 
Yes , I am one of them.

All of them are from VSC. Your see a thread for this in 485 issues in VSC

None of the received interview letter.Waitingforaos is the senior most guy. I Think his RD is July 01.

Atlanta is processing July 01 cases , so you must be getting interview letter as soon as they receive case from TSC.It may take a month to transfer the files.

I am also in the same boat as you as far as my wife's case is concerned. Just to repeat what I have posted in a separate thread before, We checked the case status of my wife adn it said that on Feb 13th the case was transfered to "our Miami office" And that they would schedule an interview.

But we actually live in Boca Raton which I believe falls in the WPB office authority.

You seem to have made a lot of progress in tracking your case so far, and have given me a lot of hope. I have sent you a private mail too in this regard.

Actually I have no clue why they transferred my wife's case. She is a derivative of my I485 which was already approved in Oct of 01.

We got married a little before that and we had added her name with my file.

Poongunranar, Sir I have a question for you. Now even if they transfer her case, will they have to transfer my already approved case too before they call for an interview.

Her RD is 7/01 and ND is 8/01 and FP is 3/03.

Please I would be very thankful for any insight, advice and course of action that any of you would kindly suggest.

You will have to wait for much longer my friend! CIS wants you to stay on top in this board, research and hone your skills, and then, when they do schedule your interview, they are going to make you an offer to work for them!!! With your tech background and legal knowledge you seem to be too valuable to them. Only one glitch though, you seem to be a compassionate person with a never ending attitude to help others. Not sure how that will fly with CIS!!!

Humor aside, what do you speculate being the reason for your transfer (to which office?...)?

Friend, I am really not worthy of your accolades. Anyway, thanks for your kind words. Mine is transferred to Atlanta. Right from transfer of more than two house addresses to mucking-up of A#s can be the reason. There is yet another possibility, and for reasons of privacy I will discuss about it at another appropriate time. I haven't had any brush with Criminal Justice System which can be another reason for a local-office transfer. I strongly believe in the Christian Theology of Divine Providence which is essentially the same as the dharma behind what Lord Krishna delivered in Bhagwad Gita under Geethaachaaram. Everything happens for a reason at the destined time and today is the tomorrow you worried about yesterday. The beauty of life exists in the current moment, because that is what is true; future will be shaped up by His Will and His Providence at the appointed time. Until then, it becomes important that we take care of ourselves and help others in our journey as well. I know ATL transfers suck big time. :D :D :D

Your approval is final. And as far as you do not commit any of those crimes that INS classifies as expedient for removal, yours is non-negotiable. Many do think that a derivative application must be treated together with the primary, which need not be! As far as your wife's is concerned, they are obviously seeing some red-tag for which they may need further elaboration from her. Your short marriage time prior to the filing of your wife's I-485 may have raised the flag as well. So long as you have joint-assets, accounts, insurance policies, joint driving-insurance records, apartment-lease, tax records, etc., that would vouchsafe to your matrimonial and conjugal conduct, you should be safe. In the interview, your wife may be grilled about her understanding of you, just to make sure that the marriage is not a sham marriage that would warrant removal. Do not freak out. I think, I am very hopeful and very sanguine about your wife's case. Yours,as I said, is final. Good luck.
 
Thank you very much for the reassurance, Poon. Your analysis may be correct. We do have all the paperwork that you have mentioned and more to prove that we are living as a couple.

I guess now it is only a waiting game to know when they may call for the interview. It seems like it could take anywhere from a short time to more than an year.

I just hope this ordeal comes to a happy ending soon for all of us.
 
My attorney received transfer notice 2 days back: Following is written in the notice. Is it the same for other people?

"Preliminary processing of the above application or petition has been completed, and it has been transferred to the INS office at:
Immigration Information Office,7880 Biscayne Blvd,Room 100, Miami, FL

That office will notify you when they schedule an interview on the application or petition. Any further inquiries should be made to that office."
