Case transferred, still waiting

we were told by the officer that he would not be able to stamp the passports , since the PF and the background check on me were not in the system yet, When I asked how long will it take, he said it can be a week, a month, or even a year......

anyody out there with a similar experience, what is the story with the background check, and how long does it really take.

I'm still waiting for my interview notice, so I don't personally have an exact answer to your question, but my lawyer told me it could take from a couple of weeks to months to years. Mayeb some gurus on this forum have more insight. Seems like it could go for a while. I am preparing for the worst after my interview, that although I might be approved, I could be in the same limbo you're in right now.

I have a separate question for you though. After he told you that they still waiting for additional FBI checks, did he also take away your EAD/AP/I-94?? If so, did you ask him if you can work/travel legally? Can you change jobs, or apply for a new job during this time? If its going to take months or years, then its ludicrous that they take away your documents from you. They are still valid (and important for that matter) until you get the stamp. If this is true then I am preparing to challenge the officer to let him keep my papers.

I won't leave the interview without my proof of permission to work or re-enter the USA unless he gives me a stamp or a denial right then and there. They'll probably end up having to drag me out of the building, we'll see.
 
No he did not take any documents away from us , though he looked at them and gave back to us. He said when the background check comes back, we will go for a stamping and not another interview. He did not ask for any thing , except verifying some information, interestingly, they got my DOB wrong, which I think the reason for the delay in the background check.
