Case transfered to Harlingen, Texas

My case together with my family have been transfered to local BCIS office in Harlingen, Texas on June 18, 2003 for further processing. There is no mention of interview in the notice that I have received.

I live and work in Houston and have a pending case (NTA) before an immigration judge in Houston to be heard sometime September 2003. The NTA was issued by mistake by a border Patrol who do not understand the legality of pending I-485.

Anybody out there whose case have been transfered to Harlingen, Texas ?

You can ask the judge to approve your I-485 in court! The mistake is a blessing.
 
I found out that on June 20th, you can see my post below. So not only you were transferred, there were another two cases if those were not your family. I think maybe your court hearing bring back the INS's memory about you, and maybe you will get approved soon.

something intersting

I checked cases around my number again today, I found three cases was transferred to another office on 6/18/03. Last week the three cases one is FP done at 2/3/03 and the other two was received.
Below is the message of the transferred case, I think TSC is geting some help from some other offices?

Strange! Why would they transfer a case for a person from the Houston area to the Harlingen office? It is a good 4-5 hours commute to even get there. I have a feeling that this has got to do with your event with the Border Patrol in the same area. Anyway, I hope your case is settled during your NTA hearing in Houston. Be sure to have a good lawyer with you at the hearing. Good Luck!

Actually I have consulted 2 Houston immigration Lawyers about the possibility of asking the immigration Judge to approve my case and the two Lawyers differ in opinions.

Lawyer1 opinion is to ask for cancelletion of the NTA before the hearing date comes and let BCIS adjudicate the case. He said it will be difficult to ask for on the spot court approval because I have not met the residency requirement and some other requiremement that will enable a judge to give on the spot approval.

Lawyer2 opinion is to go ahead with the removal proceeding and during the proceeding we can ask the judge for on the spot approval. She said once a case is send to immigration court, BCIS have forfeited there right to adjudicate the case.

I have research removal proceeding cases and on the spot approval cases and and I cannot find a case similar to mine. Most of the on the spot approval case that I have seen have satisfied on the spot aproval requirement. So I tend to believe the opinion of Lawyer 1.

I believe what you have seen is my case and that of my wife and children that got transfer to Harlingen, The transfer date was June 18, 2003 with ND August 23, 2003.

My hunch tells me that the transfer have something to do with my encounter with the border patrol because this has happen in the town right after Harlingen.

I just hope BCIS Harlingen office will not use this against me when adjudicating my case and my family cases.

I am very sorry about what you are going through. In fact, I was considering going down to S. Padre Island this summer with my family but after I heard about your case I crossed it out of my list. I have lived in the Houston area for over 5 years and have driven down to the Brownsville area at least 3 times. The first time in 1997 I didn't even have any document with me because I didn't know that such checkposts existed within the US. The officer warned me and asked me to carry relevant documents the next time I came to the area. I did that in two subsequent visits and everything was okay. But it seems things have changed these days. I wish you all the luck.
