case is under review, need help!!!

Hi: I filed my 485 on Jan/99. Since VSC was very slow to process 485 cases, I also filed the consular process (AC-140)
   back to my country in this passing March. Yesterday, I received the interview appointment letter from the consulate,
   which said the interview day is early July. I am so worried about this. I just talked to a IIO at VSC. She said my case is
   under review now. Now, my question are when they can make the decision after they started adjusticating my case?
   Should I go back to my country to do the interview or stay here to wait for the decision of VSC? I appreciate any
   comments or suggestions.

As I see it you have two options:

1) Go for your consular interview as scheduled in July if your I-485 has not been approved by then and get your CP done at your consulate. When you come back you can inform INS that you are withdrawing your I-485 application since you have done your GC through your home consulate. On the other hand if INS processes your application before you leave for your consular interview, then you can inform the consulate to cancel your interview.

2) Request a postponement of your consular interview in anticipation that VSC will get to your application soon. If this happens then you can inform your home consulate to cancel your GC interview. If INS doesn\'t get to your application even by your second interview date then keep your second appointment with the consulate and get your GC processed there.

Hope this helps you in your thinking. I know that things can look a lot more complicated than they actually are.

    Thanks your advice. I decided to postpone my consular interview. I am going to call them up tomorow. However, do you know when VSC will make a decision after they assigned my case to a IIO? I really appreciate your suggestions.

This is a question to which no one knows the answer, but check Molly\'s message on this board posted a couple of days ago. They told her they\'ll get to her case in a week or two and she got her approval within a week. However, I think there is quite a bit of variability in this. So I would imagine within a month at most you should hear something.
