Case handed to officer 60 days after RFE recvd

Need some clarifications here.. My dear lawyer called up BCIS today and talked to someone (the've got this thing where they can talk to someone more responsbile than the 800 # that we have).

I had replied to my RFE 2 and half months back. BCIS acknowledged that they received the RFE response on Oct 31. Today my lawyer told me that they were told that the case was handed over to an officer on Dec. 31.

I'm confused now.. How was the RFE (EVL) issued without the case being handed to the officer. Do you think this is all bullshit - this handing over to an officer crap?

I guess I'm just venting off here :)

At least your case is with an officer now, and you can expect approval any time. My lousy lawyer doesn't have phone access to CSC, so I have no idea where my case is. My lawyer said background check is the key reason for the varied length of adjudication after REF. Do you buy it?

I kind of buy that background check explaination...

A friend of mine had an RFE and htne after a while BCIS told him "we will need 60 days for your background check" and dang dot 60 days later his case was approved.

background check crap

My Attorney talked with someone dopey at BCIS to enquire about the status of my case post 45 days of RFE.

He was told that "case is pending with an officer and there has been a delay with getting the final security clearance in regards to name check." However the BCIS employee quoted that its highly likely that the case will be adjucated in next 2 weeks time.

It seems this comment is sync with the "60 day post RFE approval" crap.

Lets hope for the best!!!!
 
What is a "background check"?

Does anyone know what actually takes place during a background check? I mean, do they contact the police in your home country or something like this? I’m also past 60 days from RFE reply.

Iam also in the same boat. I got an RFE sometime in Jun'03 and I responded to it in July'03. I sent lot of fax enquiries to INS...They always say it is with a officer and being adjudicated.
Our lawyer also contacted them...same response..

Donno how long it is gonna take?

wac02042 You scare the shi t out of me. Man you're been waiting since July... Dang.... I was hoping to go back *home* for a vacation sometime sooon.... Can't take this no more....

Background Check

Background check includes Name check, Finger Print comparison check and name check for both Parents.
Name check software is very interesting. It takes name in your Mother tongue. Converts that into different languages. e.g. South Indians in India use the spelling Ravindra. Some one with same name from Bengal might be using spelling Rabindra or Robindra or in Punjab in might Ravindar. That software will convert your name and Parents (May be siblings also) into different languages verify.
 
Background check

Does the Name check verification process in different languages take place in India or American Database?
To run the query against any database using this logic still cannot take more than few hours--considering the high-end hardware at FBI /CIA /BCIS. A simple "Soundex" function can do the needful for such check.
Their must be some administrative overhead to this process that causes the delay. Hope they explain it some day.
