Candian PR having a US H1b Visa

Hi,

I am Candain PR , i have landed in canada recently (July 15), i have got a job in US and Planning to take that Job( i have a Vaild H1 Visa).

my question

1.my H1 Visa was issue date was from 17AUG1999 to 30APR2001 and it has been extended till 30AUG2001 to 30Aug2004.Can i apply for H1 Extension if Possible.and how long can I be out canada to keep my PR Vaild.

2.i like to Sponsor my Spouse for PR can I start the Process from US or i have to do it From Canada

If you have a Valid H1 from 30AUG2001 to 30AUG2004 why do you want to apply for H1 Extension? Are you talking about the H1-B Visa stamp from the US consulate in Canada? If you are talking about obtaining a Visa Stamp in your passport, you do not need one to get back into US on your H1-B status, provided you are from a commonwealth country.

You can be out for Canada for 3 years straight in a 5 year period and then live in Canada for 2 years straight. (If you leave Canada on 01JAN2003, you can be out till 31DEC2005. Then you will have to reside in canada continuosly from 01JAN2006 to 31DEC2007 without any absences)

To Sponsor your wife, my understanding was that you have to show legal presence in Canada. Also the petition askes abotu your employment. I am not sure how this will work out. Did you get married after you landed in Canada? If not was there a reason to not include your wife in the original application? You should probably speak to a Counsel in this matter.

YES! You should be able to extend your H1-B past the 6year limit If you are in the process of applying for a US Permanent Residency and if your LC's been pending for over an year with DOL, or if your I-140's been pending with INS.


You should consult an attorney to see if you can apply Canadien PR for your spouse. It will be tricky since you are not maintaining residence in Canada. Technically, yes you can appy for your spouse.
