I work for Employer A and my present visa status is L1b. I processed H1b through Employer B in 2005 quota which was approved in Oct 2005. Unfortunately Employer B could not find an opportunity who apparently cancelled the H1 petition in Feb 2006. As per the legal advice visited Canada as a tourist and returned back to USA to maintain the L1b status.
Please clarify my question:
My present employer A is planning to file new H1b in 2006 and apply change the status from L1b to H1. Will my present employer come to know about my previously approved H1b processed by different employer? Does USCIS query my present employer about the cancelled H1b petition done thru Employer B. Please advice based on which I would like to the next steps.
