I married a GC holder in 2005 while my status was I-94 and continusly going to court for my illegal entrance. My husband used his GC to petition (I-30)for me back in 2005. (done so in Chinatown, just a try) Received a receipt and I-797 notice for action. However, nothing else for 3 years. In between, my husband attained his USC in 2007, I'm petitioning for I-30using the new status. But this week INS sent me a notice for stokes interview in regard to my I-30 application back in 2005. My question is:
1. can I cancel the interview?
2. will canceling the interview affect my new application?
My lawyer up in N.Y told me I should only delay the interview,
and other relatives told me this interview is a trap to deport me
back to China.
