Cancel I-130 and I-864

I am a US citizen. I filed an I-130 for one of my wifes relatives. (We have been married less than a year.) The interview date was coming up within 30 days and they sent us a packet. I completed the I-864 for the relative. The day after the I-864 was express mailed out, I returned home to find an empty house. My wife cleaned out the house, bank accounts, etc. She is threatening to keep everything if I file for a divorce. What are my responsiblities in this case? Should I contact the BCIS or the embassy to cancel an I-130 and/or an I-864? I do not want to keep her relative from coming, I just don't want to be responsible legally/financially, in this case.

Did you just say your wife cleaned up your house and left??

have you filed for her Adjustment of Status?? (is she about to get a green card from you??)

I would say gather all the evidence of her actions.

Also do keep in mind that once you sign an I864 you are responsible for that person when they enter the USA i.e. for 10 years or till they get their citizenship. Also How can you file an I130 for your wifes relative?? Is that even possible?? any one reading this correct me if I am wrong.. & yes withdraw that application.

Do get a lawyer to get your stuff back and divorce your wife (such actions dont constitute a marriage) just my 0.02 cents.

No, she took everything. ('cleaned out' is just an expression)

She has a green card and status on her own, not related to me.

I would say gather all the evidence of her actions.

The relative is her son, so my step-son through marriage. She left him in Russia when she originally came to US here 5 years ago. She was previously married and that is how she got her status.

I agree. I want a divorce. I feel I have been misled, and lied to. I do not want to keep her son from being with her, but I do not want to be responsible for him (in these circumstances), especially considering she was willing to leave him before.

you should not.. if you adopt her son (which I think you are doing on the basis of filing the I130) you will be held responsible for him. So if you get a divorce after you adpot that child you will be held responsible for Child support for no fault of yours.

I would say notify INS of her actions and initiate divorce proceedings against her.. loss of money and some furniture is negligible compared to the amount of headaches this lady is capable of causing at a later stage.

and o btw: if she was really concerned of her sons G/C she could have asked her ex to apply for it (considering the fact she got a green card from a previous marriage)
