A pregnant Canadian Citizen married to a US green card holder comes to US to see her spouse in her last days of pregnancy and delivers a baby on the US land 15 days earlier then her due date. Later on her spouse becomes a US citizen and files her petition. Can the USCIS consider her previous visit illegal?
