Hi all. I am preparing to file my I-485 and I have a few questions about the form that are specific problems only to Canadians. I am currently in the US on an H-1, which I have been on since 1999, when I switched from a TN. On pg. 2 of the I-485 form, they ask for my nonimmigrant visa number, the consulate where the visa was issued, and the date the visa was issued. Since Canadians don't actually have a physical visa, these are difficult to answer. For the visa#, should I just put n/a, my I-94 #, or my H-1 approval #. And what about the consulate where the visa was issued. Any help appreciated. Thanks.

You changed your status from TN to a H1-B. Did you travel out of the US, after you received your H1-B? What does your I-94 card say? H1-B or TN?

I have travelled outside of the US (to destinations other than Canada) a number of times since I switched TN->H1, so my I-94 says H1.

ok! If your I-94 says H1-B, then you can write on page 2 as follows:

Canadian Citizen. Visa not required. You do not have to put you I-94 or your I-797 approval notice number. Enclose a copy of your I-797 approval notice.

Vault are you sure???????????

I dont think this is the case, EVERYBODY needs a I-94 number for a I-485 application. I would not advise you to file ur application based on unconfirmed suggestions. Check with ur lawyer.

Another tip, Even though one gets a I-94 no on a T1, T1 is a
non-immigrant visa and hence filing a 485 with a T1 could land
you in trouble. I am in a similar boat with my spouse, she is a canadian citizen too. I was suggested to get either a H1 or
H4 for her (caus these are dual intent visas) and then file her
485 based on the new I-94

Savant123456,

If you read ppopp's reply to my question asking if his/her I-94 says H1-B or TN? The reply posted was H1-B. I am well aware that it is not advisable to apply for AOD when one is working in the US on a TN, and that was the main reason for me to ask ppopp about the I-94.
