Hi,

I am currently in US on H1-B visa. I also have
Canadian Immigration. I landed in canada in May 2001,
but came back to stay in USA. I got married to US
Citizen on Jan 2. On Jan 5, We went to India from
detroit. At the departure time, the airline people
took away my I-94 card. When I returned, the US
immigration officials saw my canadian landed immigrant
card and asked me where do I intend to stay since I am
married to US Citizen, I replied I intend to stay in
US. He said fine and gave back my passport, but he did
not give any new I-94. Now I don\'t have any I-94 in my
passport and I am staying in US.
We want to file for USA permanent residence, and the
form I-130 asks for my I-94 departure card number.
What should I do? Please help.

Thanks

you must have one...

Do you have H1 status ( due to a I-797 approval notice ) or
H1 visa ( sticker in the passport ) ?
If your I-797 notice hasa I-94 attached to it, then use that.

Plus could you please explain the boarding process inIndia at
the airport ? which airline let you board on seeing the
canadian immigration paper on a flight to US ?

Otherwise do you have any stamp on your passport to prove the entry?

If your H1_b approval notice does not have an I-94 card, you may have
to go to canada and re-enter to get a new I-94 for $6.00 .

hi

Thanks for your response.
I have I-797 personal copy with me. The I-94 attached with I-797 was in my passport and the airline staff took it away with my old I-94.
All airlines let board people with "Canadian Landed Immigrant" permit on a flight to US.
I do have a stamp on my passport to prove my entry to US (It says \'Admitted\' Class/Untill - N/L\'
Will I have any problems in getting new I-94 when I go to canada and re-enter since I don\'t have multiple entry H1-B. Also which documents should I carry with me when I re-enter?

you dont need a visa ..so keep the

I-797 , i-129 , LCA , paystubs , recent employment letter, offer
letter...you should be fine.

great to know that in India airlines have no trouble with the
canadian landing paper !!

Entering US by Air on Canadian landed papers without a visa stamp

Hi all
Has anyone RECENTLY entered in the US by air as Canadian PR, havin valid H1B paper witout a visa sticker in the passport. I know Commonwealth nationals canadian PR with H1 approval never needed a visa stamp b4, but I just heard rumors that recently few people faced some problems at POE or denied entry they had H1 approvals and can landing papers. Has US changed the policy ??? I am planning to go Pakistan soon for a short vacation, I dont have H1 stamp on passport, have current H1B approval and Canadian landing papers. One more confusion ... while returning from pakistan do airlines/imm officials allow boarding on US flights on canadian landing papers ??? Please share your experience or anything u know regarding this situation
Thank you very much in advance
