Canadian PR from Special Registration Countries-H1B Visa stamp in Toronot

Anybody who is a Canadian PR from Special Registration countires has any experience in getting H1B stamp from Toronoto or any Canadian consulate, please post your experience here. I am from a special registration country and a landed immigrant in Canada, would like to apply for H1B visa from Canada. The reason behind this is, it takes more than 6 months to get approved of H1b from my country. I would like to visit my home but would like to have my H1B stamped as I plan to get married and get my wife on H4. Thanks a lot for your response. Please post your experience regarding:

1. Any prob in the consulate.
2. How long does it take for them to issue the visa.
3. Do you need to make any previous appointment.
4. Do you need to carry any special papers.

Hi! All Landed Immigrants & muntasir

Being a landed immigrant you can apply for H1B stamping. Take an appointment by using web from Toronto & you will get it.

Being Landed immigrant you can do that else it is waisting of $10 for an appointment if you are a visitor & national of countries need to have special registration.

You can do that but be prepared to spend upto 3 weeks!

One of my friends (from Pakistan) recently applied for H1B from Toronto along with his wife. He works for a company in Detroit and lives in windsor. They accepted his application and asked him to call after 2-3 weeks in order to do a background check. When he called after a couple of weeks, they asked him to collect his passport (the visa was issued).

thanks a lot for your reply. It seems that the consulate will keep my passport to issue the Visa. I guess I can't afford to do that as I will need to come back to USA for Job. Is there any instance when they do the background check but they will return the passport the day you apply for the visa? and when you call, you go to the consulate again, give your passport and get it stamped. And what if, I use my AP to come back the first time and then when I get the H1 stamped, can I use the H1B visa to come back to USA? Is it logically possible? thanks again for your reply.

Hello All-

I think they do not keep the passport on the day of interview. they do Back ground checks at their own & inform you to contact after a week or two. You can travel back on your passport + Payroll but can not travel with out passport.

Thank you all for your reply. I am still confused about one thing:

can you go to Toronto, apply for H1B visa, come back to USA using AP and then go back get the Visa stamped and then enter back USA suing H1B status? Notice that once I use AP, I am no longer in H1B status. thanks again for your patience with me.

I hope so.....

My friend couldn't do that since he didn't have an AP. All he had was an expired H1B visa. But he was returned his passport after the interview.

Why don't you call them and verify?

I had recently got a first Initial assesment and my interview was waived off.
1) Can someone reply to my questions??They have asked for recent paystubs & recent W2 returns but I am on leave since May2003 so Can I just Aprill2003 paystub ( is only one paystub ok??)
2)Also now that I will have to pay the fees too, if for any reason I decide not to go to canada after I receive the final landing papers, can I still be eligible for refund for RLOF??
3) They had asked for transcript along but in India no one gives or has transcript can someone tell me if this is mandatory???
4)Now that they had waived off my Interview, Can I still submit my medical within six months or do I have to send them along with other supporting docs asked by them?? If I dont sent the medicals immly and sent the other docs immly, what will be their stand?? Will they send me a letter asking me to send the medicals??
5) Once they get all papers, I guess they ask passport for stamping so is it ok, if I send my passport by some means or do I have to be physically present in the country??

Whatever paystubs you have got, you can send with the explanation about your leave.

You cannot do that because once you have got the landing papers, you are a PR now.

Transcripts means Marks Certificate from your college or schools. it will be suprising if you do not have them.

If you are willing to go to Canada, I would advise to get it done asap as their laws and regulations are being changed everyday and if you satisfy all the requirments, what is the point of being waiting.

You do not have to be there physically. You can send the passports by some secure means.

When did you apply for the immigration? and how many points did you have?

I had been asked this question lot of times about the points?? Where is it mentioned?? I have just got a lettter saying that the interview might not be reqd and additional docs reqd.??
