Canadian Pr- Advance Parole- Us Green Card

Hello All,

I applied for Canadian immigration in the year 2000. At that time, I was not sure if I will be able to apply for US immigration. It took long time for me to get Canadian immigration approval and couple of months back, I and my wife received Canadian landing papers.

Later my company applied for US Green card and I (and my wife) am on I 485 pending approval staus. I have valid EAD and advance parole documents to travel.

My questions are:

1) Since I invested lot of time and money in Canadian immigration, I and my wife would like to land in Canada and complete the formalities and come back to US.

Is there any risk to my AOS/green card processing if we go to Canada on the Canadian immigrant/resident visa and return to US on Advance Parole.

2) While returning to US, if I am asked by US immigration why I went to Canada, is it OK to tell them that
"I have Canadian Residency and intend to keep this option open till my US green card processing is complete. I Will terminate my Canadian residency once my US green card processing is complete"

My intention is not to keep the Canadian immigration once my US Green card is approved. Appreciate your advice. I am planning to go to Canada soon and come back within 2-3 days.
 
I think you will be OK. I am a PR of Canada and has travelled with my AP back to the states recently. I think the border control doesn't care wheather you are a Canadian PR or not. I have been back and forth a few times and in the couple of times border control officer did ask, I simply told them that I was visiting friends. They even saw the landing stamp on my passport but nobody ever asked any questions about it.

If you want to keep your Canadian PR, you want to make sure you don't have too many entry record on your passport. When you first land, the Canadian immigration officer may ask you some question about are you planning to move to Canada right away and where you plan to live. Make sure you are prepared to answer those question.

Overall, its a much much much pleasant experience dealing with CIC than INS. Officers are much more friendly and helpful.

Hi Min4,

Since when did you apply for 485. Also when did you receive your Canadian PR. The reason I am asking is that I also have a Canadian PR and I am going to go for FP for 485. Will it be Ok because they will know that you have applied for 2 countries through the FP.

I don't think this is a problem. I have a Candian PR and I went and had my FP for 485 in April. This is nothing that prevent you from holding a Candian PR and applying for a US PR at the same time.

Do you remember whether in the FP card for Canada PR in US you mentioned the purpose of the FP as immigration for Canada?

I don't remember exactly since it was few years ago. I don't think it matters because the two FPs have nothing to do with each other.
 
Landed/H1 revalidated

I did it .. there was no problem whatsoever .Both the Canadian Landing as well as the H1 revalidation happened without a hitch .. They are both independent of each other .. very siloed...but you need to have all documentation for both ..

me too I-485 pending while Landed Resident

I am currently in Canada while I-485 pending in the USA. Do you think it is possible to apply for bankrupcy in the USA without having a USA address? If a USA address is required then how long should I live in the US before I apply for bankrupcy? Also, will bankrupcy affect the I-485 application?
