My wife came to United States in octobar of 2000 without I94 as she is an candian resident. At the same time, I have filed N400 and waiting for my finger prints which are due on 5/2/01. In simple words I am looking for at least 6 to 9 months before I can obtain citizenship (I hope).
Do you guys think it is a good idea to file petition for my wife (I 130) based on my green card before April 30, so in case if I be denied for citizenship for any reason, she would be protected? She is techincally legal so do the spouse has to be illegal in order to file under 245(i)? What would I write for her I94 number on I130 form?
