Canadian Citizen - L1 Visa ----> GC Case Approved

Hello,

I am a Canadian Citizen on L1A visa to U.S. My GC case has been approved and I am about 8 weeks away from my appointment in Montreal, Canada. I have another job offer, therefore my questions are:

1. Can I switch job immediately after my interview and being granted Green card visa?
2. How much time would it take for actual receipt of Green Card and updating my status?
3. If I take up the new job after being granted GC visa, will it jeopardize my GC?
4. Whom do I have to notify if I change job?
5. What can ultimately happen if I take another job immediately after being granted GC visa? Is it illegal? What can be consequenses?

Information from which others can benefit (my experiences)...

- I got my L1 visa in about 35 days - without premium processing
- I did my EAD for my wife, quite simple process
- I filed or GC in November 2004 and expect to have my interview in about 8 weeks from today (May 25, 2005)

congratulations on getting approved for GC through L1A visa. I don't know answer to your inquiry but I wanted to ask you a question of my own. I hope you can reply. Basically, I am also on L1A visa and I am thinking about applying for GC through the company but the company I am working for is small and has four employees. The company has one another branch but the revenue together is below 500K. What was your case like and what do you think the chance that I have in approving GC? I have been trying to find people who is in L1A and in the process or approved for GC to get some ideas? I would really appreciate your help if you can give me brief on what BCIS look for in the prospective green card applications?

You need to show good intent when receiving the GC through an employer, simply by staying with that employer for a certain amount of time. The US labor market is very dynamic so you are not expected to stick with this employer for ever. When new opportunities arise you should pursue those. However staying with your employer for at least 6 to 9 months shows that you had good intent. My five cent advice is do so and wait until you have the freedom to pick and choose who you want to work for.
 
L1a - Gc

Thank you billy_bob for your input. I have been with the company since the beginning (I helped started the business in the US) which is March 2003 but my L1A visa started from November 2003. We opened another branch 2 months ago but every attorneys I speak to, they say that I have to have so many professionals (must have degrees) working for me and I have to show so much profits. My company is small and we only have 4 employees and the sales is below 500K. I am very confused because of that reason. Should I wait until we expand to another branch or should i apply now?

Your case is not very straightforward. I guess that many attorneys like the easy cases, but under certain conditions you should be able to start the GC process. Some of those conditons are:
- Show that most of the employees are US citizens or GC holders
- Have been (or are) a profitable corporation
- Have enough money to pay for your salary once you receive the GC
- Can show a growing company by means of a business plan with future projections and supporting evidence like past financial statements.
You probably need an attorney who's a bit more creative (maybe with experience in corporate law or finance) and thinks outside of the box. It's probably a matter of gathering enough evidence. You know, small businesses are the backbone of the US economy. If you are not sure, you probably should postpone until the conditions are more favorable. On a positive note, you are in a enviable position since your L1a status allows you to skip the whole labor certification process and you can speed up the GC process significantly.
