Canadian and travel while AP pending..

I have just submitted the I-485 application and Advance Parole application. I need to go home for Christmas and I doubt I will receive my AP by then. I am working on H1B. What is the law in this regard? My layer says I cannot travel until I get AP approved. Is this correct? I obviously can enter back since I do not need any visa to enter US, but I am concerned about one more entry stamp in my passport and a different I-94 card number (different than the one on I-485 application). So what is the truth?

Answer to your qestion depends on the following:

do you have a valid H1-B? If you have a valid unexpired H1-B visa stamp or an approval notice, then you should not have any problems traveling. If you do not have the same, then you need to wait for your AP documents.

As long as you don't surrender your I-94 when you depart the US, then you will not get another I-94.

Good Luck!!
