Canada Visit.

We were planning for a Visit to Canada - Niagera falls for the long weekend.
I am on H1b .. with valid I-94 ( the one that comes with H1b approval).
Stamping on the passport is old and not valid.
My daughter is born in US .. and she does not have a passport.. just the birth certificate.

Can I and my family visit Canada.

Hi Ebhola,

Please consult your lawyer for confirmation.

To the best my knowledge, on a H!b visa, you need a Canadian Visa to enter Canada. As for your visa status, You will have no issues entering or leaving Canada, but on the US side, they may object not having the H1b stamped on the visa. Per Immigration laws, you can work and stay legally within USA with a H1b approval, but once you leave teh country, you ahve to get it stamped from your country of residence which is I guess India.

You daughter will be fine, she does not require a passport to travel to Canada. Her birth certificate is enough to pass through these 2 countries back and forth.

Thanks for the quick reply.. I think I better not go out of country without the stamping on the passport.

Wonder why they closed the office at St Louis.. it was so easy then.
