Hi guys,
I am currently in the US for the last 3 yrs on H4 visa now expiring first week sep(not stamped on ppt). I applied for Canadian PR and got my landing papers thru. Question;

If I go to canada now and stay there for a month to complete all formalities for SIN card, get my PR card etc., will I be able to re-enter US without a US visa. Can I enter only on the basis of my Can.PR card. Need to know as my intention is to maintain canadian PR and come here as my GC is in progress to in LC stage.

*** YOU Need you Valid I-94 and US visa stamped in your Passport, If you try to get your US visa Stamped from US consulate in Canada and if it is rejected you CAN NOT enter US you have to go to your home Country to get US Visa stamped and Being PR of Canada it is up to INS officer to allow you to USA but recently US conulate or DOJ posted a rule that PR who are Commonwealth county Citizen will also need US visa to enter US and I do not know your home country.

***You are on H4 in US how you can file for LC on H4 visa? I hope what you mean is your Spouse is on H1B visa and LC is Filed for her/him, and why do not you extend first your H4 visa in US by filing I-539 form if your spouse has Valid H1B visa? I do not know where your Spouse LC is Filed in RIR or Regular and this is only the first step for US GC, then I-140+I-485 is balance, and it will take a long time to get US GC as LC in many states has NOT moved in last one year.

If you get extension of H4 visa and your Spouse is Still working in US on H1B visa then after receving your exension approval you should send your Passport for REVALIDATION and once you have H4 visa stamped and new I-94 with that then you can go to Canada and you can return back to US by showing your H4 visa and valid I-94
