Hi All,
I have a job offer from a university and they are filing for my H1B transfer. I would like to know the answers for the following

1. If I start working for the university as soon as they file for the H1B transfer, can I leave the country and come back before the H1B transfer is approved.

2. if I go to India after the H1B transfer is approved, should I get a visa stamped for this ( transfering from quota H1B to non-quota H1B ) before returning. Or is my existing H1B stamping along with H1B transfer approval papers sufficient to enter back into the US.

Any inputs will be very helpful.

If USCIS finds out that you have left before the petition is adjudicated, it will deny your case. This has happened to my friend, who got stranded in India as he went ahead thinking he can get the approval mailed to him.

1. You risk denial. Grounds for denial will be "abandonment."
2. Yes. You need a stamping for the "visa." Note: Visa and Status are two different things. You need a "visa" to re-enter the country.
