Can you return the green card if you move back to your country permanently? I am getting my green card through my dad (he is a citizen) who is sponsoring me but if I leave the US I want to know if I can return it since I have to declare all income etc. and it will be too much to be taxed in both countries. If I return it does my dad get in trouble?
 
whoa lets back up a sec here

before you do anything lets take this one step at a time

first of all you went through all the trouble of getting the GC

now you have the GC

assuming you have your GC

you can leave the country for up to a year.

if you plan to leave longer then you have to apply for a reentry permit

failure to do this makes the GC null and void

also in that case your dad will be off the hook of sponsorship.

no one will get in trouble if you leave permanently

but if you lose that GC then you have to go through the process all over again.

lets try and avoid that

also you mentioned that you have to declare all your income for tax purposes.

all I know about is in the US all GC holders have to fild a tax return whether you are here in the US or not

that means declaring all income. However if all or most of your income is foreign income then it is usually not taxable, and therefore you won't have to pay that much in taxes. you may want to talk to an accountant first.

You can submit your GC back. You have to fill out a form at the US Consulate, they make you take an oath that you are doing this at your will and are not under any pressure, etc. I am not sure of the form #, but, my mother-in-law did it. Is a very simple process. You will get a visit visa the same day.

Thats what my attorney told me as well. You can surrender your Green Card any day and you can get a Visitor's Visa, but he has told me not to surrender my Green Card unless I am absolutely sure that I will not need it in future, so I have appled for a Re-entry Permit just to protect it, but if things work out for me back home, then I am better off with just a Visitor's Visa so I do not have to bother filing taxes in the US and maintaining bank accounts etc.
