Can you have 2 cases at the same time??

Hi everybody!!

I have a question. I asked a few lawyers and they said you can have 2 cases at the same time...I got married and filed for green-card, and two months later I received the news that I won the lottery! I wanted to go ahead with the lottery because I knew that you have to wait a lot for a marriage case and that the lottery is quicker, plus I have a low no. So I decided to go ahead with the lottery and the lawyer said it is no problem. Now I have an interview for the lottery visa in april and I want to know if it is going to be alright that i have another case..I am legal in us only because my marriage green-card application is pending. My visa expired...Am I going to have problems?????

No, You are fine. you can have 2 cases at the same time. This is not a problem in the DV case. Don't worry, you lawyers are 100% correct.

Where is your local office located? When did you file?

My office is located in NYC. I filed in january, and everithing went quickly...i have an interview in april. So basicly I am legal, being on pending. That was my concern. Because I know for DV you have to be legal..

Thanks tak2...but I still have doubts....i am thinking that they gonna deny me saing I am not legal. See I do not know anymore if being on pending means beeing legal. Are they going to say anything? I never stayed illigal here...I really hope everithing is going to be ok...

I think I am in exact same situation as you. I got married to a USC in January 2006 and i just mailed my application for family based. Last week, I received a mail from the KCC stating that I am one of the winners of DV-2007 lottery. I also overstayed my visa but i have a pending I-485.

I have not yet contacted any lawyer but I am thinking about pursuing the lottery case if it is indeed quicker. I am sorry i could not provide answers to your questions or concerns but i will appreciate it if you could share some of your experience with us regarding the procedure in filing for the DV-Lottery and your interview as well. I would also like to know your openion if I need a lawyer for this or not. I wish you good luck on your interview and looking forward to hearing from you soon.

I have a friend who was in this situation . He had an application running from his employer and he won the DV2003. His lawyer was able to combine the cases and finaly he got the green card based on DV because the process was faster. Even for DV, INS took all the application from the one his lawyer submited.

deco....I think you should see a lawyer. I went to three lawyers and not all of them agreed...but I still decided to go on with this. I even called USCIS, and I think I talked to an immigration officer who said you can't have 2 cases...but my lawyer said they are only employee's, and that they do not know the law... :confused: . I should recommend you to see a lawyer..at least for advice...If you have questions you can ask me....
I have only a few days till my interview and I am gonna post my experience with USCIS.....
and if you already know you won, you probably have a looow number. Mine is pretty low, and I got the answer in like june.....

Thank you for your advice. Whatever decision i make will be base on sound advice from couple of laweyers and most importantly the outcome of your interview.

I have a very low number and it think the dilema still remains on the legal status. Let's hope for a very positive outcome of your interview and then i will go from their. Thanks to Dianac for that infomation and it was helpful as well.
 
I just wanted to say that I had my interviw for green card with DV lottery and everithing went smooth...and to my surprise I even got my passport stamped :D And it didn't matter that I was married and that my husband filled for me. She said I will get a decission about the other case in the mail and that I should disregard it. She just ask how I came( what kind of visa), asked for my taxes and letter from work, and my high school diploma. And that's about it.
So good luck to everybody....

Congratulations and thank you for sharing you interview experience. I am very glad that the outcome is positive.

So far, i have talked to four lawyers and 2 said i have high chance but the others said I do not have a chance because i have stayed out of status for more than 180 days. I told them that i am married to a USC and file a petition with I-485 but they said that does not make me eligible for AOS. However, the restults of your interview has renewed my hopes and i think i will go forward with the DV lottery but i have few questions that i would like you to help answer for me.

1. What was your status before filing for family base GC?
2. I think you mentioned that your visa expired. If you did overstay, for approxitemately how long? was is more that 180 days?
3. I would like to talk to your lawyer. Can you give me his contact number?

These are the questions I have for now and once again contratulations and thank you.
 
Well deco...i came here with a J1 visa wich expired. But before that I started going to school and changing my visa to F1. I did not receive the visa because after 2 months I think, I quit school.I married after like 2 months and then I filled after a month I think. So basicly I stayed like 3 months out of status. But the immigration officer didn't even ask about that, and about the fact that I tried to change my visa to a student one. She asked only with what type of visa did I come and what did I do here. That's it. And she asked if my husband filled for me. I said yes. Than she said well it is faster this way no? And I nodded, plus I had a pretty low number.
I didn't have a lawyer representing me. I just went to a few lawyers and ask what should I do. Most of them said I should go with the marriage case. But I really wanted to try my luck. After all, I guess I am lucky if I won the lottery. And everithing went fine. So it is up to you.

Thank you for your all your advise. I think time is on my side on this and it looks like my time for the AOS interview will be up before the DV lottery is due. I plan to keep both door open for now and prepare for both cases. Once again thank you and enjoy the benefits of your new status.
 
The interview notice came from the local office. The welcome letter after the interview came from Lee Summit, MO. And I got the green card just after couple of days. I was really surprised that everithing went so fast. I guess they got their act toghether....
