My H1 B visa and I 94 both expire on 19-Jun-2010.
My company has couriered the petition docs to USCIS for normal processing on 10-Jun-2010.
Does it mean I can stay is US till i get a response from USCIS.?
My company visa department representative has sent the following info to me - "This is also to keep you informed that On an average it takes 4 weeks for the receipt to reach our offices. Once received we would have the details updated in AIMS notifying the receipt at our offices. You would receive a messenger email requesting you to log a Service Centrale request for obtaining a copy of the receipt copy. You can continue to stay in the US once extension is filed. Per U.S. Code of Federal Regulations {8 CFR 274a.12(b) 20} an employee can continue to work and stay for a period of upto 240 days beyond the current I94 expiry date – if a timely extension has been filed for"
Please let me know if you know any info regarding this.
