is it legal for me to marry in the US my boyfriend from my home country whose annulment case is still ongoing? he has a US visitor's visa. i'm currently on H1b and my employer is soon filing for my greencard. if so, can i include him as dependent in the petition?

You can only marry once the annulment has been completed. As far as Im aware you can include him on your petition if you are married by the time the petition is put forward. Even if you are married AFTER the petition has gone through/be completed, Im sure your husband can be sponsored based on his marriage to a H1-B holder (someone correct me if Im wrong).
You have to be aware though that your partner will enter the US on H4 status meaning that he will be unable to work (unless of course he is able to find an employer to sponsor him for his own employment based visa).
