I have applied for H1-B through advance degree quota with my Ph.D degree last year but I missed H1-B lottery. Planning to apply for H1-B again this year. Currently I am on extended 17-month OPT and it expires on Feb 28th 2010.
My wife (grad student OPT expired on Nov 2008) just received email that her H1B (applied last year through IT Consultant) was denied as her employer could not satisfy USCIS's RFE on company's financial matters.
She is currently on my greencard (EB-1 Outstanding Researcher) pending.
I want to apply H4 for my wife as I am not 100% sure that my EB-1 will be approved.
My wife's status is safe as long as I don't hear Adjustment of Status denial.If I hear AOS denial, she loses status and she has to leave US immediately.
1) I am planning to apply for H1 B safe side and wants to include my wife as dependent. Is there any way that I can include my wife as dependent in my H1-B application?
2) Do I need to have H1B approval notice to add my wife as dependent
