Any 45 days letters from chicago BEC

Hi ,
I have filed my labor in (EB2/RIR ) filed from ILLINOIS in April 2004.
Even state is not approved. :(

Now my employer is going to file parallel thru PERM to the old one in same category EB2/RIR.

Can we file thru PERM inthe same category , eventhough we filed in the past in the old process. is there any problem.

They are not withdrawing my old application and not converting old one to PERM.

Any body received 45 days letters from CHICAGO BEC who have filed in april 2004.

any views.

Thanks
VJ

At this point there is no law or access for them to not let you do so...so go ahead...maybe in the future they might...

as per Rajiv Khanna.

Do you think that is right?? The system is already a mess and your company is trying to make it even worse. If you want to go for PERM you should withdraw your old application to help reducing the backlog. I have seem people on this forum with two, sometimes three parallel applications, no surprise there is a backlog on the system. Now I have seem people like you that will start PERM parallel to the old application pretty soon they will create a PERM BRC. I am not defending the system, I agree that it is completely obsolete and inefficient but, if people start having multiple applications for the same case, where are we going to stop????

Thanks rest_2004_free & JJJ8 for your reply

I will 100% agree with you JJJ8.

But every one thinks like you, even the DOL . This should not come to this point.

It is already a mess. It is not bcoz of the people who want to get their GC fast. It's because of the DOL system and their regulations.

The system of employment based immigration in US is a bulls***. The LC should be for the employee or the occupations in the shortage. It should be like in the immigration system of Canada or Australia. If a foreign worker has a job offer in US, give him/her a bonus points for the immigration. How many honest employers stop the LC for a foreign employee, if they find a single qualified "US worker"? The LC should not be the employer property. That is why it is causing lot of backlogs. Employees are filing multiple LC thro companiess A,B C...to Z. And fraud employers trade them by the name of "labor substitution". Some peole like me waiting for long time and few smart people are getting EB2 LC by labor substitution.

couple of things comes to mind... call it selfish but everybody is responsible for securing their and their familiy's present and future. I am not going to get a prize at the end of it because I waited for 5 yrs and 'did the right thing'. The backlog and need to file different ways is necessity out of govt's regulations not individual's mistake. I agree with Gc_puli on this one but I am in the queues as everyone else. Life's not fair.. nobody said it would be.

We are just making our lifes harder and more measerable if everybody starts placing multiple applications for the same case, we are just giving DOL material to blame us at the end of the day for the backlog.
