Need input on the following...
I'll give a brief of my situation:
Comp A: Employer filed labor in Mar-02...EB3 Non-RIR...labor expected to be cleared in Dec-04.
Comp B: Future employment based: I-140 denied in Aug-04. Filed 485/EAD/AP in Mar-04...pending as 140 is denied. My attorney suggested that we refile 140 as the denial was based on ability to pay. This time we will be submitting pay stubs too.
Now, lets assume that I'm not much concerned abt my refiling of 140 from Comp B, can I file 485/EAD/AP after filing 140 with Comp A once the labor is approved in ~Dec-04 ?
