Can we come back to US if our visa is still valid ??

Hello Friends,

With so many people getting stuck on account of PIMS wanted to know whether we are allowed to come back to US if our H1B visa is valid .

In my case my old H1B is valid till October 2008 so if I go to Mexico or Canada for new H1B stamping from new employer and if it gets stuck due to PIMS, can we come back using our existing H1B visa ??

or is it that when you appear for new H1B stamp interview they first cancel existing H1B.

If that is the case then we will not be able to enter US again but otherwise we should be able to enter US back .


Any thoughts/ ideas / expeiences ???
 
PIMS verification is not a visa denial so the question of using alternate visa does not exists. Moreover, all existing visas of the similar category will be invalid once a visa applicant appear at a consulate.

Does that mean when I appear for new H1B stamping interview in consulate first they will put "cancelled" stamp on old H1B in passport irrespective of whether new H1B is stamped or not.

If that is the case then I will not be able to enter US using old visa but if the stamping of new H1B is withheld on some reason and if old H1B in passport is still valid then I will be able to enter US using the same.

The reason I am asking is , there are postings seen on other discussion forums contrary to this.

So trying to figure out what is the risk involved before we decide to go ahead for new stamping.

Any thoughts ??
 
Could you clarify as to why an unexpired visa would be of no help.

If the visa is still valid in passport ( not cancelled ) and if the person shows new I-797 then he should be able to enter the country.

Anything amiss ??

If a visa is valid then yes, the person is allowed to enter U.S.

Generally during a visa interview the existing visa for a similar category are cancelled.
