I am currently working with an employer on H1B visa approval (no h1b visa stamp on my passport yet)
Can anyone guide or provide insight with the following question? I will be very greatful to U.
As soon as I get stamped with my H1B Visa in India (with my current employer's filed/approved visa papers), can I file for a H1B transfer to switch my job after coming back from India?
In other words "Does USCIS have any problem to transfer my H1b as soon as I got visa stamp in India." I am sure I'll maintain atleast 15-20 days gap.
I am facing this situation because:
1) I had plans to go to India long before (Itz been 2.5 years I've seen my family), but now I HAVE to change my job with this very nasty/bad situation in the office. (My boss resigned with all this political crap in the office, itz not a desirable place to work anymore). I am planning to resign for the current job as soon as I find a new one.
2) My plan is to visit India with the vacation time I have now in the current job and to look for new job as soon as I come back from India. Because if I change my job before going to India, I will not have sufficient vacation time with the new company until 6-12 more months. I currently have ample vacation time with the current company.
Please help, refering to someone knowledgable is also helpful.
