Okay, so notice for my second fingerprinting was sent out on the 5th, my office is Baltimore. A few days ago, i was told that my namecheck came back but it still reflects pending. I am thinking that I am almost done. Atleast that's what i was thinking yesterday. To be honest, i get excited over USCIS actions at first then i remember all I have been through and i doubt everything. Here is my question?

How many of you have had to get 2nd fingerprinting done and how long after did you get your Oath letter. See below for my timeline. I have written quite a few letters too.

MY first set of fingerprints expired a long time ago. I was told that the way the BAltimore office is doing it now is if your prints expire, they dont ask you to come back until they are almost finished with your case.

Please weigh in. :confused:
 
Frustated_alot, my only comment is that until the the file is sent to the Baltimore local office for interview or other action, the case is still at VSC. Finger print policy is set by VSC and not Baltimore for such cases. Atlanta_brother too got a finger print notice recently and it could well be that it is a good sign for both of you, however the proof is in the pudding and you may need to wait to see actual outcomes in black and white.

I have already passed interview and everything else besides that. When i found out that my name check came back, i was also told that it is still pending my background check because of expired fingerprints which did not make much sense to me. I believe that my case is in the baltimore office. You are right though, the proof is in black and white. We will see what happens.

He clearly told me that if I was ever interviewed and the decision was never made on my case, I was good to go for WOM. He could have won my pending case since 120 days have already passed by. For you it's like a win win situation. Hire a good attorney and let him bring your case to the court. You may want to wait may be till end of the month and give your finger prints to show in the system, that's all. But I would not wait too long. This is ridiculous.

Your lawyer is not entirely correct. WOM can be filed for any delayed government action including denial of service in this case to force USCIS to adjudicate one's N400 application. The 120 day rule is more explicit, under 8 U.S.C. § 1447(b). Under this provision, district courts have jurisdiction over naturalization applications that are pending for more than 120 days after the date on which USCIS conducts the 'examination' of the applicant

I see your point brb2 and you definitely make sense. I am not denying the fact that 120 days doesn't apply in my case but check this out....My attorney said the same thing and told me that had I been interviewed, my case would be just a piece of cake. He is planning to request the judge and will ask him to close my case and grant me citizenship because I have an almost 70 year old widow mother back home and I am her only hope. She has health issues which I need to take care of. After getting my citizenship I can apply for my mother's green card and bring her here. He think we can bring this excuse before the judge and hopefully win the case.
 
I think each set of biometrics are good for 18 months. After that, you will be asked to get the FP done again.

i hired an attorney on wedensday and im starting my WOM against uscis for delaying my N400 after my interview, the alwyer said i will definetly win as i passed the interview and its their problem not mine that they didnt locate my case.
lawyer said how are they gonna stand infront of the district jusge and say ur honor we lost the petitioner file, the judge will be very mad because this is called negligence on their end.

i also gave him all the documented attempts for me to resolve issue peacfully but they never responded like senator and congressman intervention

lawyer said my case will be resolved in 60 days, i feel so much better that i know that i have a right.
passing interview is an important factor in filing a sue case against them

my district is pretty freindly and mostly on the side of the petitioner and not uscis , check the opinion the judge gave on chebli case on 9/4/07 he was throwing rocks at fbi and uscis for ignoring cheblis case , check it out on pacer.

yes atalanta i was interviewed on june 19 2007 and until this day no deciosin was made was because my A file was never transfered to local detroit office.

lawyer said judge is gonna be very dissapoiinted that uscis cannot locate my file after they interviwed me and they are just delaying me because of their slopiness.

i have letters from senator and congressman trying to resolve issue peacfully but they never responded, i feel more in control now knowing that a decion will be made by taking them to court.

This means Your name check cleared and you will get oath letter in at most one month.

I am sorry if I may ask this personal question but how much is your laywer asking for his services. I talked already to a lawyer and she told me it will cost me $5,000 to sue the INS and that doesn't mean I will win they might also deny the case and I will have to reapply and start all over again. Thanks.

my case isnt a name check issue or anything that hard, i completed the interview and they still wait for my file which me and my lawyer belive they either los it or misplaced it , so he charged me 1500$ as the lawyer fee and 350$ filing charges , what is the reason of ur lawsuit is it a name check issue or what is it excatly?

and what state do u live in maybe i can tell u about a lawyer if u live in michigan.

if u have the time check the blog here on how to file pro se or on ur own , they are alot of good people that can help u

in my case i dont have the time or the courage to file by myself so thats why i hired an attorney trust me im not wealthy or even close to being so but my peace of mind thru settling this is worth every dime i spend , i just need an answer . i have a great oppurtunity with a goverment job and the delay is my citizenshipp and i also want to petition to bring my mom here as she lives back home alone and shes old and her health is detartiating i want her to come here and live with me and my husband , she lives in a country on the verge of a civil war and i dont want this to trouble me any longer all i want is my citizenship, i have every right to it i pay taxes and work everyday ive never been in trouble with the law or did any thing wrong in my life to be trated like a criminal,we have to know this is the united states a country of laws and the right will prevail. keep ur head high and definetly start thinking about a lawsuit , ur case is way overdue and they should do something for you.

dont sit their and dont listen to anyone that say for you to wait u have waited long enough 2005 please give me a break.

im praying that God will help me win my case and prevail so i can reunite with my mother after 7 years and be able to prosper career wise.

My attorney quoted me a flat fees of $2500 + $500 (filing fees). This makes a total of $3000. He is willing to work on my case mid of Oct and he seems pretty hopeful that the case will go in our favour. On the other hand if it doesn't work out in our favour, we don't have start from scratch. We just have to continue to wait and we can go to the court for mandamus again after 12 months. The only down side to it is that you loose is your money, that's all.

Based on what I am seeing for N400 name check stuck 1447b cases, AUSA's are requesting expedite of name check and if name check clears very likeley you will get oath letter.

My name check and finger prints were cleared early this year and I am still waiting for my interview letter.

In my experince most good attornys will require a retainer of 10hrs @ 250/hr and what you are being changed is reasonable. Most WOMs do not take more than 10hrs EXCEPT is case goes to trial and court appearance is required. Then it may cost more at the attorney hourly rates.
