Can USCIS be sued for AP delays?

We all have been experiencing unprecedented delays in APs being approved. In spite of this - one of my friends who recently applied for AP received a notice which says it usually take 30-60 days to process this kind of case.

Can AP filers sue USCIS for not living upto its assurances after the max. time provided on the notice has been reached?

Id love to have my name on top of it ..been waiting for it for over 7 months now..
