I would like to know, if I am working in Company A and I-140 filing is in progress. I want to apply for another labor certification from Company B to backup my green card processing and avoid any issues in I-140 and I-485 approvals filed thru Company A.

So, can this be done?.

What are the other precautions we should take !!!

appreciate help!!

regards,
Prasad

thanks Unitednations for your reply. When should i actually start working(with their pay roll) from that Company B, Assuming as a future employee, labor application is filed, approved and applyied for I-140 and I-485 tentatively in next year. Or i don't need to work until, i get GC approved from company B.

I understand Company B should have the ability to pay the wages per your first reply.

My second question: How critical and important is Box 14 of labour application. I have 3 + 2 years education from India and evaluated as equalent to “US 4-Year Degree in Bachelor of Business Administration” . Also have more than 5 years experience. My current labor application approval in Company A states as follows:
Box 14 > College Degree Required: “ Bachelor’s Degree ”
> Major Field of Study: “ Computer Science, Business Administration, Accounting or Finance “
> EXPERIENCE: “ 3 years “

Is this labor approval good for I-140 process with my qualifications from company A. Or is there any corrections we can do now to proceed I-140 process, with out any issues.

appreciate your help..

Nice of your quick and detailed reply Unitednations. Following are the details:

1. Labor approval is from chicago and service center is Nebraska.
2. ‘Equalent’ is not said any where in labor approval. That is, ‘Equalent’ is not there in box no.14 or box. No. 15
3. So, How to overcome this issue now?. Per your reply, if my understanding is correct, Labor application should describe and define, what is ‘equalent’ means, though it is mentioned in box no. 14.
4. My employer also having established offices in Dallas and California. Can this I-140 and 1-485 processed from those offices.
5. If new labor has to be filed from the current employer A, will there be any opportunity to get processed labor application soon and quicker, since there was a labor approved for same company and for same beneficiary. Or are there any other advantages!
6. I just want to verify, multiple labor applications also can be filed from same state. Is that correct.

Appreciate your help.
