Can this speed up name check?

Hi, everyone!

I remember some article says FBI gives priority to "Name Checks" to those who apply for visa stamp at US Embassy (have you seen many visa stamp applicants waiting for 2-3 years??)... therefore, I had a thought, don't know whether it is feasible:

We are going back to China with valid AP. What if I make an appt in US Embassy, apply for my H1 visa, then US Dept of State will send NC request to FBI, and FBI take priority on my NC this time :D :D . In a few days, my NC is cleared, which hopefully serves the needs for my I-485 NC as well (they are the same crap).

It'll be so beautiful if it works. But if not, I might get stuck in China for a while (possible?), or the I-485 NC still stays in the Q, regardless of my NC on H1 visa stamp being completed.

So, any thoughts? :confused:
 
I understand what you said, but you have to be in category of Consulate Process (CP) than you can applied your I-485 in U.S. Consulate in China. I dont know how you turn it around. At least, you need applied your I-140 again with CP process. Am I right?
 
My I-140 was approved the day before (08/17) and I called the NSC regarding my I-485 stating mine was a concurrent filing and I didn’t hear anything on my wife’s and my I-485.

NSC asked for permission from my wife to check on her case status and told me the cases are being sent to an officer.

How long does it take to hear an decision on the case once it gets to the officer? Any ideas?

Through congressman. If your congressman is willing to help, he/she can at least send query to USCIS and/or FBI congressional liason to find out this info.

Contact both senators and your district congressman, you never know which one can help.

CP is not an option since it is too late. Since it is NC that holds up my I-485, I just want to get NC cleared.

You are right that CP require NC also, so is the H1 visa stamp application.

My thought is to get NC cleared through H1 visa stamp application.
 
my guess if no one knows until you try it to see what happens

nothing is garanteed even for writ of mandamus
 
it is not going to work.

the name check for I-485 is different from visa security check.

FBI doesn't keep a record of any check results so that visa security check won't do any good for your I-485 name check.

Besides, from what I heard from local congressman's office, USCIS now does a number of checks during the processing of I-485.

Basically, name check is just another invention to screw immigrants and there is few ways to get around it.
