can the individual apply for the premium processing himself?

Hi guys

I have a job offer from a company and they are not willing to do premium processing. At the same time they are not willing to let me join till I get an actual H1 approval from INS. Since this may take months to come, I want to get premium processing done so I can get a response in a couple of weeks.

I am interested in knowing if I can apply for the premium processing myself or is it necessary for the company to apply for it? If I do it myself , do I need any endorsement from the company or what would be the procedure...

Please help me as I urgently need to know about this.

May the beneficiary of a visa petition seek premium processing?

No. Only the visa petitioner, or the attorney or representative who has filed a notice of appearance (Form G-28) on behalf of the visa petitioner, may seek premium processing.

Thanks a lot.. it certainly doesn clear the doubt I had , even if it also elimicates the only solution to my current problem :)... btw d u also know about how much time is the California center taking for the normal processing of H1 transfer these days?
 
Can pay yourself and have company apply

While it's true that the company or attorney must apply for PP and not the beneficiary, you can pay the PP fee yourself (unlike the training fee which must be paid by the company). Maybe your company does not want to shell out the $1000 and that's why they are reluctant to do PP. If you are ready to bear the cost of PP, then simply have the attorney/company fill out the requisite form and add your own check for the PP fee. I know you can do this - saw it on sheila murthy or some other web site. Then you will get it in 15 days (or an RFE in 15 days).
