can start company with EAD?

Hi everyone. I have that dylema, can I start my company while waiting on adjustment of status (I-485) and having employment authorization document (EAD) ?:confused:
The problem is that after 180 days waiting for adjustment of status I know I can change the employer, but can I start up my own company instead ?

There are two things in your question.

- Yes, you can.


can I start up my own company instead ?

- Although, there have been such cases, this may not be a good idea. It may cause a problem at the time of Citizenship, if not now. Unless you are laid off, there is no other job offer, and your approval is coming near, avoid it. Use it as a last option to be safe.
 
You mean that better is to change employer to other company then become selfemployed in my own corporation?
If I can start my company so why I cannot work in it? Or maybe I can work but in addition to regular job?

yes, you certainly can, but if that was the idea why INS would ask to go for LC, 140 in the first place? INS would like to see that there is a need for such a person, and that the person will get paid for the work. This can easily be established by an existing co. with previous financial records.

that's not a problem. Unlike H-1, with EAD and GC you are free and you certainly can work for more than one employer without any special persmission.
 
I guess you are right. Last question I have, do you think would be good for INS if after these 180 days I still work for my "sponsoring" company, but as independent consultant (through my new company) not as employee?

What you are asking is the same thing in a different way.

Consider this:

INS ---> You --(paid by) ---> Co. A (yours) ----(contracted by)---> Co.B (your current employer)

In this case, you are still paid by your co., no matter that co. (yours) is getting its money from, whether from a contract with your current employer or another co. INS doesn't know that third co. SO, it is the same thing.
