Can someone please explain what is AC140?

Hi,

I have heard of this term( Attorney Certified 140) but not sure what exactly it means or what its requirements are.

In what cases is it applicable?

Would it be applicable in my case? :

Approved 140 from CSC under NIW Category. It has been about 2 months since then, but NVC has no record of my case.

Your attorney can bypass NVC and directly deal with your consulate to process your Immigrant visa. See immihelp.com for more info.

Some consulates accept AC140 without any reason, some consulates accept with a reason ( long pending 485 etc) and some consulates do not accept I140.

Check whether your consulate accepts Ac140. Good luck.
 
In my I-140, I had opted for Mumbai Consulate.

And I have heard Mumbai accepts AC140 cases.

Can I bypass NVC?

Is it a good idea to avail of AC140?

Yes, you can bypass NVC using AC140.

But I do not know whether it is good or bad. See the following thread under 'Consular processing' for more info

Hi,

I did bypass NVC in mycase. My lawyer sent my case directly to Mumbai consulate. I got my immigrant visa on 19th of Nov.

Alren has hit the nail on its head!

If your I140 has been approved for Consular Processing, you cannot use AC-140 route - you are pretty much stuck with NVC. AC-140 can be used when you have filed for AOS (I485) and now want to pursue CP. In that case, at least for Mumbai, one can file I824 requesting change to CP. One can use the I824 receipt notice (and NOT wait for approval) to file for CP directly with the consulate using Attorney Certified documents and original approved I140.
