Hi All,
Here's my question. If someone who was in US for many years and had a kid here and returned to India with the kid, can they claim/apply for permanent residence on this basis? I am not sure if parents have to be dependent on the kid for them to apply for immigration on this basis.

Can someone pls. clarify?

Thanks!

yes ..but after the kid is 21 yrs..

of age. By that time he/she has probly figured that staying with parents is not the way to go for the rest of his/her life ..ofcourse my wife will disagree with that statement :)

Yea, lots of mexicans tried this "Anchor baby" trick. They'd run across the border and give birth here in USA. The US Govt. caught onto that, and now, your baby can sponsor you only after he/she is 21. So if you have a baby today, god knows what the rules would be 21 years later.
