Can one work as independent contractor on H1 ?

I\'m confused. My wife lost her job recently and applied for COS from L1 to H4. Now a company wants to hire her as an independent contractor for 3 months and they are filing for new H1 shortly. Can one be hired as \'independent contractor\' on H1 for short duration? Her offer letter says she\'ll be a contractor and her pay will be hourly for up to 3 months.

Is there anything illegal here? Please help.

Idea is to get H1 through them as they want her badly and ready to do premium processing. And then during next 3 months try to get some other job and do a H1 to H1 transfer or file for H1 to H4 if she is not able to get one. Are we doing the right thing here? Main concern is about \'independent contractor\' though! Appreciate your help on this.

By any chance she cannot get another job, she will be out of status. It is a very big risk, ask them for a longer duration even if it means a lesser pay.
