Can One apply for H-1

I applied for waiver and DOS sent me the list of documents needed. I have the No onjection from my country, but I am afraid to send all the documents to DOS already, as my IAP expires in March 2004. Can they reject saying that I am applying too early ?

Can one apply for H1 with waiver from DOS or do you have to wait for waiver from INS ?
 
I have not heard (that does not mean it never happened) waiver-denial based on early application.

INS waiver is required for H-1B petition. However, sometimes if the INS center where H-1B will be submitted is the same as where the DoS submitted waiver-recommendation; successful H1B petitions based on DoS recommendation have been reported on this forum in past (search archive).
