I am interested to know if anyone knows answer to this question-

Can NIW based I-485, be matched to PERM approved I-140, especially if the NIW was approved for a physician required to do 5-yr service??

If you have an approved I-130 or I-140 and have an I-485 pending. You can submit the approval notice with a copy of I485 that is pending based on whatever other application. Call USCIS for more answers, I don't know where you have to send it too. Mailing issues have changed recently.

Good Luck

Sam877 I don't think that is true or what googler1234 is saying can be done

If one has EB2NIW I140 (pending) with I485 (pending)
and he also has a EB3 PERM I140 (approved) but retrogressed

Can that person substitute his penidng EB2NIW I1485 to the approved EB3 I140?

I don't think that can happen.

If this could happen everybody will file for EB1 and EB2NIW to get in their I1485
and then substitute the pending I1485 to their approved EB3 I140.

They will not get the green card by this process due to retrogression,
but they can avail of the I1485 benefits of EAD and Advanced Parole.
I don't believe that this is possible.

I am just talking by common sense. I don't know what the reality is.

Thanks for replying to my question. I wonder if anyone has been in same situation as mine. My PERM is also EB2, and for the same job, but NIW I-485 has a condition of medical service requirement for 5 years. My NIW will not be adjudicated until 2008. If I can't use NIW-485 for PERM, does this mean that I have to file another 485? Thanks!
