Hi,

I am married to a USC and currently under AOS. My question is that, can my parents from India to visit me? What will they have to write in the forms for visa about my status?

I have been reading these B visa threads and understand that we ( my husband & I) need to send them invitation letter. They do not need any sponsership.

Will that be a problem in my AOS?

Thanks in advance..

All they need to say is that they come to visit you. There is no problem at all.

An invitation letter stating your address and such would be good.

Your AOS will not be affected at all. As you can not sponsor them or file anything on their behalf with USCIS.

Thanks a lot PraetorianXI. I think they have enough evidence to support themselves and show their ties to the home country. We will send them the invitation letter. But the problem is that, there is a form to be filled before the visa interview which asks about the relatives in USA. What will be my status in that form..AOS?

Since I overstayed my F1 for couple of months that why I was worried about my AOS being effected.

Thanks a lot :)

Since you married a USC your overstay is forgiven (if you overstayed more than 180 days do NOT leave the US until you get your GC though!).

I thought your parents already had a visa, but in that case. They can say that they have a son adjusting for permanent residency in the US.

You and your AOS will not be seen as a threat. Only when you become a citizen can you file for your parents to get a GC, until then I doubt USCIS would give your parents any trouble to come visit.

Thanks again! I am daughter not son :P.. They do not need any GC. They just want to visit me. I wont be leaving US until I have my GC in hand. Thats why I thought that its better if my parents visit me rather than me going there.

Thanks a lot...Will send them invitation soon :). BTW did you hear anything on ur RFE from USCIS? Gud luck on that!
