I'm a USC, my husband is Swedish & has been living/working in the US on an O1 Visa, he owns our condo in NYC. He has been in US on visas for 16 yrs & never out of status. We married last year & have an 8 month old baby born in NYC & would like to travel to Sweden in August for a couple of weeks with baby to meet family. I filed an I130 in Dec 2012 which was approved & case is in initial review. We haven't filed I485 because we never received Notice of Action in the mail so have to get duplicate. My question is will my husband be allowed re-entry with his current visa if we travel before filing i485? Is his O1 visa still valid after only filing i130? We never anticipated our NOA to be lost in the mail. We want to travel in Aug to Sweden for 2 wks then once we return file the i485 AOS. Please advise! Thanks!
